The notice to vacate works in either direction — landlord to tenant or tenant to landlord — and includes the parts casual notices leave out: the clause being relied on, the exact date possession is required, and the handover and deposit arrangements.

The rent receipt is in the form tenants are typically asked for when claiming house rent allowance, including the landlord's PAN, which employers commonly require above a threshold.

  • A notice to vacate usable by either party, citing the clause relied on and the effective date
  • A handover block — date, time, meter readings, keys and the deposit settlement timeline

Serve it properly, and keep proof

Hand delivery against a signed acknowledgement, or registered post with acknowledgement due, or email where the agreement permits it. Keep the proof — a notice you cannot prove you served is a notice you did not serve.

Cite the clause

Reference the notice clause in the agreement and the date it takes effect. A notice that simply says "please vacate" invites an argument about whether it was valid.

Deal with the deposit in the notice itself

State when the joint inspection will happen and when the deposit will be returned. Raising it in the notice rather than on the last day removes the most common source of a sour ending.

On the rent receipt

Employers commonly require the landlord's PAN where annual rent exceeds a threshold, and requirements change. Confirm what the employer or a chartered accountant needs before relying on the format.

Tenancy law and eviction procedure vary by state, and several states have enacted their own tenancy legislation with prescribed notice requirements. Where a tenant may not leave voluntarily, get legal advice before serving anything.

How much notice is required?

Whatever the agreement says, subject to any minimum the applicable state law imposes. Serve at least the agreed period, cite the clause, and keep proof of service.

Can a landlord evict a tenant who refuses to leave?

Not by force or self-help. Recovery of possession is a legal process and varies by state, and several states now route it through a Rent Authority or Tribunal. Take legal advice rather than acting unilaterally.
