The society NOC and no-dues request gets started far too late. Societies are slow, committees meet monthly, and a buyer's lawyer will not clear the file without it. Send it the week the agreement to sell is signed, not the week before registration.

The special power of attorney is what lets a seller who cannot attend registration complete the sale through someone else. It is also where NRI transactions stall, because a defective POA is discovered at the sub-registrar's counter on the day.

What is in the file

  • A letter to the society requesting the NOC for transfer and a no-dues certificate
  • A checklist of what the society is being asked to confirm, including any pending special assessment
  • A short form of NOC the society can adapt and issue
  • A special power of attorney naming the property and the specific acts — not a general POA
  • The attestation chain for a POA executed abroad, with a note on India-side requirements
  • A revocation clause and the identification details sub-registrars expect

Send the NOC request early

The week the agreement to sell is signed. Committees meet monthly, secretaries travel, and the certificate is not something anyone can hurry in the final fortnight.

Ask specifically about an approved-but-uncollected special assessment. That becomes the buyer's bill, and it is the item societies most often omit from a routine no-dues letter.

Keep the POA special, not general

Name the property, name the acts — to sell, to receive consideration, to execute and present the deed for registration, to appear before the sub-registrar. A general power of attorney handed over for a single transaction is an unnecessary risk for the person granting it.

For a POA executed abroad, start months ahead

It typically needs notarisation in the country of residence and then attestation by the Indian mission or an apostille depending on the country, followed by stamping or adjudication requirements in India that vary by state.

Sub-registrars are strict about this. A defect found on the registration date is a wasted trip for everyone and often a lost buyer.

Confirm the principal is alive on the day

A power of attorney generally lapses on the death of the principal. It sounds morbid and it is a real check that lawyers make before a POA-based registration.

Is a general power of attorney enough to sell property?

Can an NRI sell property without coming to India?
